Banana Republic

Washington DC (Storch Report) — America became a Banana Republic yesterday when FBI Director James Comey made a case for recommending to DOJ an indictment of former Secretary of State Hillary Clinton when he declared there was evidence she was “extremely careless” in the handling of “very sensitive, highly classified information” in the use of multiple personal email servers.

“Extremely careless” is equal to “gross negligence” which is a criminal violation of the law, a felony, yet at the conclusion of his findings Comey executed a complete turnabout when he said, “as a result, although the Department of Justice makes final decisions on matters like this, we are expressing to Justice our view that no charges are appropriate in this case.”

“No charges,” when the report he delivered said, “From the group of 30,000 emails returned to the State Department, 110 emails in 52 email chains have been determined by the owing agency to contain classified information at the time they were sent or received.  Eight of those chains contained information that was Top Secret at the time they were sent; 36 chains contained Secret information at the time and eight contained Confidential information, which is the lowest level of classification.”  

Comey further noted in the report: “We do assess that hostile actors gained access to the private commercial email accounts of people with whom Secretary Clinton was in regular contact from her personal account.  We also assess that secretary Clinton’s use of a personal email domain was both known by a large number of people and readily apparent.  She also used her personal email extensively while outside the United States, including sending and receiving work-related emails in the territory of sophisticated adversaries.  Given that combination of factors, we assess it is possible that hostile actors gained access to Secretary Clinton’s personal email account.”

In common parlance, a Banana Republic represents a legal system where the interpretation of laws is more “flexible,” for some.  For example, relatives and friends of those in power live by a separate standard than the common people.

Last Thursday a “chance” meeting took place between former President Bill Clinton and Attorney General Loretta Lynch at the Phoenix Airport on her private plane — they only talked about family, grand kids, golf and travels, according to Lynch — not the possible criminal indictment of his wife Hillary Clinton.  It was a meeting with bad optics and words were quickly cast that the ‘fix was in,’ and the system is rigged.’ Comey’s report is forwarded to Lynch for prosecutorial action.

On Tuesday following the Fourth of July, Hillary Clinton was vilified by Comey, basically called a liar, but once again sidestepped the law, while clearly breaking it, and thus was cleared of any charges by the FBI.  

That afternoon she traveled with President Obama on Air Force One, got her photo-op walking down the plane’s steps with Obama on her way to a campaign rally in North Carolina.

Comey appears to be the savviest of political actors in town, perhaps from the same camp as Chief Justice Roberts, a rogue actor. Comey delivered his statement to the press yesterday, but refused to take any questions.  He takes those questions tomorrow from Congress.

Yesterday, America became a Banana Republic capable today of joining Argentina and Venezuela reflecting the cronyism and comical status of the rule of law.
